Use of The Snag Surveyors Website (Section A)

Acceptance of Terms
In these Terms and Conditions, ‘we,’ ‘our,’ and ‘us’ refer to Snag Surveyors. By accessing the content of www.snagsurveyors.ie ("the Website"), you agree to be bound by the terms and conditions set out herein, as well as our privacy policy available at www.snagsurveyors.ie/privacy.html. If you do not accept these terms, you must not use our products or services and should leave the Website immediately.

You agree not to use the Website for illegal purposes and to respect all applicable laws and regulations. You must not use the Website in any way that could impair its performance, corrupt its content, or otherwise reduce its overall functionality. Furthermore, you agree not to compromise the security of the Website or attempt to gain unauthorized access to secure areas or sensitive information.

By using the Website, you accept full responsibility for any claims, expenses, liabilities, losses, or costs, including legal fees, incurred by Snag Surveyors arising from your infringement of these terms and conditions.

Modification

Snag Surveyors reserves the right to modify any part of these Terms and Conditions at any time without prior notice. Continued use of the Website will be deemed as acceptance of any changes to this agreement. We recommend users regularly review these Terms and Conditions.

Snag Surveyors also reserves the right to modify, suspend, or remove any part of the Website at its sole discretion without prior warning or liability.

Limitation of Liability

Snag Surveyors shall not be held liable under any circumstances for indirect, special, or consequential damages, including but not limited to loss of business, revenue, profits, or data, arising from your use of the Website.

All intellectual property on the Snag Surveyors Website, including but not limited to trademarks, trade names, patents, registered designs, and other intellectual property rights derived from the aesthetics or functionality of the Website, remains the sole property of Snag Surveyors.

By accessing the Website, you agree to respect these intellectual property rights and refrain from copying, downloading, transmitting, reproducing, printing, or using any material for commercial purposes without express permission from Snag Surveyors.

Inspection Services Provided by Snag Surveyors (Section B)

Fee Payment

You are required to pay the advertised fee, including VAT, prior to the inspection date. Alternatively, payment can be made by prior agreement with Snag Surveyors before the snagging report is issued.

If our inspector is unable to gain access to the property, is refused entry by the site, or is asked to leave the premises at any point during the inspection, 50% of the inspection fee will be charged to cover incurred costs. It is the client’s responsibility to confirm access arrangements in writing with both Snag Surveyors and the builder.

Snag Surveyors will ensure access arrangements are confirmed in advance. In cases where we fail to confirm these arrangements, no cost will be charged to the client as a result.

Fee Payment (Cancellation Policy)

Clients may cancel their inspection at any time and for any reason without incurring a cancellation fee, provided the cancellation is confirmed with Snag Surveyors by telephone no later than 17:00 on the day prior to the scheduled inspection.

Inspection Reports – What We Will Do

The Snag Surveyors inspector will use reasonable skill and care to carry out a visual, non-invasive inspection of habitable and ordinarily accessible areas of the property, including garages and grounds. The inspection will assess standards of workmanship, fit, and finish against generally accepted (and where applicable, published) workmanship standards and tolerances.

Where ladder access to loft spaces is possible, the inspector will perform a visual inspection from the top of a ladder but will not enter the loft.

In wet weather, the inspector will assess the performance of gutters and external areas for ponding or improper drainage as far as reasonably practicable.

If required, a drone inspection can be booked separately to examine the exterior of the property. Please ensure this service is arranged in advance of the site visit.

The Snag Surveyors inspector will provide a written report to the client. The report will detail only the issues identified during the inspection. If a follow-up visit is conducted, an addendum report will outline the findings from the subsequent inspection, including the date of the re-inspection.

Photos of the property may be taken during the inspection and included in the report. If you object to the use of any photos, please notify us within 7 days of receiving the report, and we will make the necessary amendments.

Where appropriate, and when conditions allow, the inspector may use thermal imaging equipment to identify potential cold bridging or excessive heat loss. Thermal images may indicate areas requiring further destructive or invasive investigations but are not typically conclusive regarding the presence or extent of defects. Clients should exercise caution when interpreting any thermal images provided in the inspection report.

Inspection Reports – What We Don’t Do

The Snag Surveyors inspector will not carry out any invasive or destructive investigations, enter uninhabitable areas such as roof spaces, or work at height. The inspector will not assess technical compliance with building regulations or compliance with any design, structural engineering, or material requirements related to the construction of the property or external features such as retaining walls. If you require such investigations, please contact us to discuss your requirements.

If habitable or ordinarily accessible areas of the property are not accessible on the day of the site visit, these areas will not be inspected, and this will be noted in the report.

The inspector will not test service media, including phone lines or aerials, gas or electrical installations (such as solar panels), plumbing systems, security apparatus or installations (such as alarms, door locks, or sprinkler systems), or mechanical installations (such as air source heat pumps or ventilation systems). If these types of inspections are needed, you should contact us to discuss your requirements or arrange for specialist contractors to perform the necessary checks.

The Snag Surveyors inspector is unable to assess whether boundary features align with legal property boundaries or provide advice on legal matters, including easements or rights of access. For such issues, please consult your conveyancing solicitor.

When Your Inspection Report Will Be Due

Snag Surveyors aims to deliver inspection reports via email within two business days of the inspection date. However, unforeseen circumstances may cause delays, and Snag Surveyors accepts no responsibility for such delays.

If you require your inspection report by a specific deadline, please notify us in writing as soon as possible. While we will make reasonable efforts to meet your deadline, we cannot guarantee compliance and accept no liability for any failure to meet such deadlines.

Force Majeure and Inspection Schedule Adjustments

At Snag Surveyors, we make every effort to conduct inspections as scheduled. However, unforeseen circumstances, including but not limited to severe weather conditions, natural disasters, or other events beyond our control (“Force Majeure Events”), may require adjustments to the timing or date of an inspection.

The safety of our inspectors is paramount. In the event of adverse weather conditions or other situations that may pose a risk to their health and safety, Snag Surveyors reserves the right to reschedule the inspection at short notice. In such cases, we will endeavor to notify the client as soon as reasonably possible regarding any changes to the scheduled inspection time or date.

We will work closely with clients to arrange a suitable alternative date or time for the inspection, taking into account the urgency of the inspection and the client’s availability. However, Snag Surveyors will not be held liable for any delays, changes, or cancellations of scheduled inspections due to Force Majeure Events.

Clients are encouraged to contact Snag Surveyors in advance of the scheduled inspection date if they have concerns about potential Force Majeure Events or their impact on the inspection. We appreciate the understanding and cooperation of our clients in these circumstances.
